Terms, Conditions & Agreement

NOTICE OF IMPORTANT INFORMATION AND HEALTH WARNINGS ABOUT THE BAPTISTE POWER YOGA INSTITUTE PROGRAM(S) AND PURCHASES. 

You must read the section below carefully and completely. 

1. We are pleased that you’re going to participate in the Training Program either in person or virtually (i.e. the program). Many people have found the program to be an invaluable experience. Yet the program is not advisable for everyone. The purpose of this notice is to ensure that you are not one of the people for whom this program may be inadvisable. 

Please read each section of this notice and agreement carefully and completely so you can make the right decision for yourself. The recommendations and suggestions of this notice and agreement have been made to support your final decision to participate in the program or not. The bottom line is that it’s important for yourself to be certain whether the program is appropriate for you. If you have any questions, and are not certain regarding your participation, please contact a medical and/or mental health professional in order to be properly advised. We will assume from your participation in the program and from your declaration at the end of this agreement and application that you have a full understanding of each and every paragraph which follows and that you understand clearly your decision to participate. 

You and you alone are responsible for your choice to participate in the program and for your own health AND well-being at all times prior to, during and after your participation in the program. 

2. The program is a unique course of instruction designed to support people and being more effective in realizing their own personal, and professional goals through engaging in; 

a series of physically rigorous yoga exercises, practices and postural movements done in high-intensity performed in solo, and sometimes with others in partner/group exercises; seated or active meditation practices and exercises that can be experienced as mentally and physically challenging by some; philosophically rigorous inquiry and open discussions, voluntary sharing of your experience with others and in short exercises, journaling etc. 

The program, and its methods provides an opportunity to explore basic questions about life and living and physical fitness that have been of interest to human beings throughout history and as a way to examine some aspects of one’s life and well-being with the intention to create new opportunities, and possibilities for their fitness, life, ways of living. 

3. In the program, you will be actively working with your physical body as well as inquire into fundamental issues that have been of interest to many people as human beings. The experience of the program is unique to each individual and there’s no way to predict in advance exactly what you may think, feel or experience as a result. It is normal for some people to experience unwanted or unfamiliar

emotions from time to time, such as fear, anger, sadness, regret, hatred, irritation and impatience. For most participants exploring thoughts and feelings that they have not fully explored before has shown to be a useful and positive learning experience. Some participants have found that exploring life’s issues honestly may evoke uncomfortable and unpleasant feelings. For others, the program may occur as physically distressing. If you’re unwilling to encounter any of these powerful experiences or feelings in yourself or in others, or if you have any concerns about your ability to deal with such physical, mental or emotional experiences, we request that you do not participate in the program, or consult with medical and/or mental health professionals to first advise you on your decision to participate, or not. 

4. Some people experience temporary and not seriously consequential stress during and after the program. For most people, stress is a normal part of everyday life. However, people who have a history of mental illness or serious emotional problems personally or in their immediate family may be more vulnerable to stress of any kind including the stress of rigorous yoga practices, meditation and personal development inquiry. In some people with any physical, mental or emotional problems, even normal amounts of stress from any source may generate severe physical, mental or emotional problems. If you have any history of physical injury, trauma, illness and/or mental illness or emotional problems personally or in your immediate family, whether temporary, vocational or intermittent, and or whether treated or not, or serious concerns about your ability to handle stress, we strongly recommend that you do not participate in the program or that you first consult with medical and/or mental health professionals to first advise you on your decision to participate, or not. 

5. Participation is ultimately your choice, it is strongly recommended that you should not participate in the program if you: 

a.) if you have any personal history of physical injury, emotional or physical trauma, illness, disease or genetic disposition where engagement in intense physical activity proposes a risk; b.) having personal or family history of bipolar disorder, schizophrenia, acute or chronic depression or other psychotic disorder, whether or not you or they are being or has ever been treated or hospitalized; c.) are taking, have taken or been prescribed to take within the previous 12 months antianxiety drugs, antidepressants, antipsychotics, any medication to treat bipolar disorders, any drugs or medicines, whether prescription or nonprescription, intended to treat or affect mental processes or mood or to a treat a chemical imbalance, or anabolic steroids, or; 

d.) have an unresolved history of drug abuse, are or have in the past year been depressed and or considered or had ideas of suicide, self harm or harm to another, are currently in therapy and your therapist sees a health reason why you should not participate in the program, or are uncertain about your physical, mental or emotional ability to participate in the program. 

6. Although extremely rare, during or shortly after participating in the program and engaging in the various exercises and practices of meditation, yoga and inquiry based personal development discussions, a very small number of people with no history of mental illness or drug abuse have reported experiencing brief, temporary episodes of emotional upset. If this is of concern for you, then you should not participate.

7. The program is designed for people who clearly understand they are responsible for their own health and well-being before, during and after the program. The program is not therapeutic in design, intent or methodology and is not to be used as a substitute for medical treatment, psychotherapy, physical therapy, mental health or as a health program of any nature, regardless of what you may believe about it or have heard from anyone. Please know and be advised that the program leaders, teachers, staff and people who assist the program are NOT mental health nor medical professionals and there will not be any mental or medical health professionals in attendance. 

8. If you experience any symptoms or suggestion of physical or mental distress in the program sessions, during the breaks or the end of a session, or between sessions, you must immediately inform the program facilitator(s) or the program supervisor (s). In such an event, you and the program facilitator or program supervisor will discuss the matter and you will determine what is the appropriate thing for you to do. If you’ve experienced symptoms or suggestions of mental or physical distress during or outside of the program, we strongly recommend that you immediately inform a physician or mental health professional. 

9. While there are breaks in the program approximately every 2 to 3 hours, we do not promise it will always break at precisely that interval. Although we encourage participants to attend and complete all sessions of the program–you are, of course, free to leave the program room at any time. Each day there are typically two meal breaks, one in the morning, one in the afternoon and/or one in the evening, usually lasting a half hour to an hour and a half each. We suggest that you have snacks as needed throughout the day and after you leave in the evening. You’re welcome to bring snacks to eat during other short breaks in the program. If you have a medical condition requiring you to eat or care for some special needs more frequently than the regular scheduled breaks, or have any other special needs, please notify the registration manager at time of registration, or the program supervisor before the program begins to support the appropriate arrangements being made for you. 

10. If you’ve not been feeling well or if you have been meaning to see a physician or mental health professional for some complaint, symptom or concern, or if you have had difficulty sleeping lately or been depressed, it is imperative that you consult with a physician or mental health professional prior to participating in the program. Upon request we will do our best to provide you with information to support you in making an informed decision about your participation but ultimately the choice is yours to make and with any needed medical advice. 

11. For some people insufficient sleep can become a serious problem and could be symptomatic of mental or emotional distress or illness. In the past if you have become (or think that you may become) distressed because of a lack of sleep, it is strongly recommended that you do not participate in the program. If you did not have sufficient sleep or if you have a sleep disorder during the week prior to the commencement of the program we strongly recommend that you do not participate in the program. If during the program you feel that you have been unable to sleep or have not had sufficient sleep, you must notify your program facilitator or program supervisor.

12. If after you’ve consulted with your medical or mental or health professional, your health professional needs any additional information about the program in order to resolve your ability to participate, please contact our Registration Manager who will do their best to provide you with any available information. 

AGREEMENTS: 

The following agreements are intended to have a legal significance. If you have any questions about their meaning, please feel free to consult an attorney. 

CANCELLATION POLICY AGREEMENT 

LONG PROGRAMS: 

A $500.00 deposit for the program is paid upon registering and submitting your application. This deposit is non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for the deposit paid. If a request for cancellation from the program is made prior to 4 weeks from the start date of the program, any amount paid will be refunded to the original method of payment for this program less the $500 deposit. If a request for cancellation occurs within 4 weeks from the start date of program, all amounts paid are non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for any amount paid if cancellation takes place within 4 weeks from the program start date. 

If you choose to leave the program prior to the program’s end date, all amounts paid are non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for any amount paid if you leave the program early for any reason. If you choose to terminate your registration from the program, you are required to vacate the premises and may not remain onsite for the remainder of the time the program is taking place. Your registration will be deemed incomplete if you do not complete the entirety of the program. 

We highly recommend purchasing travel and event insurance to protect your investment. 

I acknowledge that I have been informed of the option I have to purchase cancellation insurance and that I have read, understand, and agree to comply with the contents of this Cancellation Policy. 

SHORT PROGRAMS: 

Payment in full is due upon registering and submitting your application. A $35.00 deposit is paid upon registration, which deposit is non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for the deposit paid. If a request for cancellation from the program is made 

prior to 4 weeks from the start date of the program, any amount paid will be refunded to the original method of payment for this program less the $35.00 deposit. 

If a request for cancellation occurs within 4 weeks from the start date of program, all amounts paid are non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for any amount paid if cancellation takes place within 4 weeks from the program start date.

If you choose to leave the program prior to the program’s end date, all amounts paid are non-refundable and non-transferable. This indicates no credits, transfers, or refunds will be provided for any amount paid if you leave the program early for any reason. If you choose to terminate your registration from the program, you are required to vacate the premises and may not remain onsite for the remainder of the time the program is taking place. Your registration will be deemed incomplete if you do not complete the entirety of the program.

I acknowledge that I have been informed of the option I have to purchase cancellation insurance and that I have read, understand, and agree to comply with the contents of this Cancellation Policy. 

CONFIDENTIALITY AGREEMENT: 

In order to promote and respect the confidentiality of our participants and our intellectual property, please read and sign the following: 

I understand that the Baptiste Power Yoga Institute Program (the program) is limited to people who have registered in the program. In consideration and as a condition for permitting my participation in the program, I represent, warrant and agree that: 

a. I understand that I will not repeat anything, or refer to anything anyone participating in the program says here, including sharing on social media. Further, If participating virtually via device, I understand that by virtue of staying on the call session I agree that I will not record, in whole, any part of the call/session(s), either in audio or video format. 

b. I have registered in the program under my own name for the sole purpose of participating in the program; and 

c. I will not publish, broadcast, post to social media, or disclose or assist another person or organization in publishing, broadcasting or disclosing the identity, likeness or actual or paraphrased comments, of other participants in the program, staff, people who assist, and people who lead the program…during and after the program; and 

d. I will not film, videotape, audio record or otherwise record, by electronic, digital or any other means, all or any portion of the program, and I will not record or take pictures, or assist another person organization in recording and/or taking pictures of any kind or nature, of all or any portion of the program as it is happening, including materials, posters, slides containing content and or methodology provided for the program. From time to time the program leader will give permission to photograph certain break assignments and this will be the exception; and 

e. I will not take into the program room, in-person or in virtual format, any tape or video recorder device, movie or still camera, or any device, electronic or otherwise, with the intent to record the voice, Image or likeness of any person or staff in the program room(s); 

f. The Baptiste Institute will do it’s best to provide content/Images during each program to use for social media, on its own channels and for program participants to use on their own social media channels if they so choose. Please notify the program facilitator and program supervisor prior to, or at the start time of program if you wish to not be photographed for such purposes.

I further agree that the provisions of this agreement shall be enforceable under the laws of Utah and my breach of this agreement shall constitute, among other things, a breach of contract and trespass for which the Baptiste Power Yoga Institute shall have the right to full legal and equitable recourse, including injunctive or other extraordinary relief and damages. Any unenforceable portion of this agreement shall not affect the remainder. 

I recognize that my breach of this agreement will cause Baptiste Power Yoga Institute and/or the participants in the program irreparable and substantial harm even though it may be impossible to ascertain the full monetary extent of their financial loss. 

Nothing in this confidentiality agreement is intended to limit you from sharing your personal experience of the program with anyone. 

PHYSICAL EXERCISE AND BODILY RISK AGREEMENT 

I recognize that physical exercise, activities, walks, runs, as well as yoga methods and postures involved in the program requires physical exertion which may be strenuous and physically rigorous and demanding. I am fully aware of the risks and hazards involved and participate at my own risk and choice and that it is my responsibility to consult with a physician prior to attending the Baptiste Power Yoga program if I have any concerns regarding the physical demands of the program. 

I represent and warrant that I am physically fit and have no medical condition, which would prevent my full participation in the program experience. 

I will assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the program. This includes, without limitation, my use of the facility and any program room, bathroom/changing room, pool, parking area, sidewalk, pathways or any equipment in the facility, program venue and my physical participation in any activity, class, program or instruction. 

I agree that I am voluntarily participating in the program and use of the facilities and premises and assume all risk of injury or death to me or the contraction of any illness or medical condition that might result, or any damage, loss or theft of any personal property. 

I agree on behalf of myself (and my personal representatives, heirs, executors, administrators, agents and assigns) to RELEASE AND DISCHARGE from making such claim or claims against the Baptiste Power Yoga Institute, Baron Baptiste, its leaders, its officers, founders, heirs, representatives, successors affiliates, managers, employees, agents, people who assist from any and all claims or causes of action (known or unknown) arising out of my participation in the program (including, but not limited to, our negligence). 

This Release and Waiver of liability includes, without limitation, injuries which may occur as a result of (a) my participation in the methods, exercises, processes in the program (b) our negligent instruction or supervision, (c) my performing postures, partner work, over exerting myself, slipping and/or falling

while in the program, program room or on the premises, and (e) my travel to or participation in the program. 

I acknowledge that I have carefully read this Release and Waiver of Liability and fully understand that it is a release of liability. I am waiving any right that I may have to bring a legal action to assert a claim against Baptiste Power Yoga Institute and its staff, founders, program assistants and program teachers and/or leaders for our negligence. 

I agree that neither I nor any person or entity acting on my behalf has or will file, charge, claim, sue or permit to be filed, charged or claimed, any action for legal or equitable relief against Baron Baptiste, Baptiste Power Yoga representatives, staff, and/or the Baptiste Power Yoga Institute Inc. involving any matter occurring at any time or related in any way whatsoever to traveling to or before, during or after participating in the program. 

MEDIA AND SOCIAL MEDIA 

a. The Baptiste Institute will do its best to provide content/Images during each program to use for social media on its own channels and for program participants to use on their own social media channels if they so choose. Please notify the program facilitator and program supervisor prior to, or at the start time of program if you wish to not be photographed for such purposes. 

b. I agree to allow the Baptiste Power Yoga Institute and its representatives to use and publish my photograph, my image, video recording of me, and/or audio of my voice, taken or recorded during the program for any purposes whatsoever they may deem necessary and/or appropriate for training, educational, social media, publishing, business purposes, promotional or other purposes. c. If you do not wish to be photographed at program you must notify the Registration Manager, Program Facilitator or Program Supervisor in writing prior to the start time of program and receive confirmation that you wish to not be photographed during program. 

d. The Baptiste Institute is not liable or responsible for any photographs, videos, or screenshots taken by other participants and/or used on social media or other purposes. 

ARBITRATION AGREEMENT 

I agree that any dispute, claim or controversy arising out of my participation in the program, or any of it related activities, processes and or exercises, including the interpretation, application, execution, performance or enforcement of any provision of this agreement or concerning Baptiste Power Yoga Institute, its officers, founders, managers, employees, agents, people who assist and or other participants in the program (“Baptiste Yoga”) Will be submitted to and determined by final and binding arbitration. This agreement to arbitrate includes claims that there been any wrongful acts or omissions in my registration in the program in the warnings and disclosure, content for delivery of the program (or any of its related activities, processes and/or exercises) by Baptiste Power Yoga Institute or its representatives. Any such dispute, claim or controversy shall not be determined by lawsuit or resort to any court process in any court of law or equity, except as applicable law provides for judicial review, confirmation enforcement of arbitration proceedings and awards. Judgment upon any award rendered an arbitration may be entered in any court having competent jurisdiction and application may be made

to such court for an order of enforcement. Such arbitration shall take place pursuant to the commercial rules of the American Arbitration Association then in effect in the city of Philadelphia and will be expedited and conducted on successive days before three arbitrators in accordance with the rules of the American Arbitration Association. I agree that if either party institute any legal action in any court not authorized herein, the other party shall be entitled to respond by demurrer or other appropriate response, should not be required to answer any complaints, and will be entitled to a dismissal of such legal action. The other party shall be entitled to an award in its favor for the amount of its actual fees and costs of suit. I understand that the Baptiste Power Yoga Institute is a Utah company and that this agreement will be construed and governed by the laws of the state of Utah. This agreement cannot be modified unless in writing signed by me and co-signed and agreed to by the Baptiste Power Yoga Institute. 

I also agree that the time in which I may commence arbitration should not be greater than 90 days following the occurrence of the event or events which is/are the subject of my claim or claims. I understand if I failed to commence arbitration within said 90 days, I may be forever barred from making such claim or claims against the Baptiste Power Yoga Institute, its officers, founders, leaders, managers, employees, agents, people who assist and/or other participants. 

MOMENTUM: 

Momentum Nation, and/or Baptiste Institute (“Baptiste yoga,” “we”, “our”, “us”), operates and owns this website (together with any other website or apps branded as Momentum Nation, and/or Baptiste Institute, the “Website”). By accessing the Website, you are agreeing to be bound by these Terms of Use (which may be amended by us from time to time), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws (including any international laws). Your right to access and use the Website will terminate immediately, without any further action by us, if you breach these Terms of Use or we otherwise in our reasonable discretion determine that you are causing harm to the Website, yourself or any other party. By using the Website, you are agreeing to be bound by the then current version of these Terms of Use. The content contained in the Website is owned solely by Baptiste Institute and protected by applicable copyright and trademark law. Momentum Nation, and/or Baptiste Institute may make changes to the content and materials contained on the Website at any time without notice. 

USE LICENSE 

We are pleased to grant you a non-exclusive, revocable, limited license to use the Website, and its counterparts, solely for your personal and non-commercial use. You may only use the Website in the way the content you access is intended and in compliance with these Terms of Use and with any and all applicable laws, rules and regulations. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell any content, software, products or services contained with the Website.

DISCLAIMER 

The materials on the Website are provided “as is.” Momentum Nation, and/or Baptiste Institute makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. In particular, although Momentum Nation, and/or Baptiste Institute provides its products and services with your health and safety in mind, it is critical that you consult your physician, follow all provided safety and other instructions, and obtain authorization before accessing or using any of our products or services, especially if you are prone to injuries, are pregnant or nursing, or have any other unique or special medical conditions. The contents, products and services on the Website are provided for informational purposes only, and are not intended to diagnose any medical condition, replace the advice of a healthcare professional, or provide any medical advice, diagnosis, or treatment. 

ACCOUNTS 

In creating an account, you may not misrepresent your identity and you may never use another person’s account for any purpose whatsoever. If you have previously had your access to or use of the Website terminated by us, you may not access or use the Website under any circumstances. You should never share your account information with third parties or allow third parties to use your account. Please keep your password confidential and be sure to exit from your account at the end of each session. You are responsible for all the activity on your account, including the use of your account by other people who you may or may not authorize to use your account. 

LIMITATIONS 

In no event shall Momentum Nation, and/or Baptiste Institute or its subsidiaries or affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Website and any products and services offered by us. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. 

LINKS AND ADVERTISING 

Momentum Nation, and/or Baptiste Institute has not reviewed all of the sites linked to the Website and is not responsible for the contents of any such linked site, including but not limited to, advertisements and content posted by third-parties. Use of any such linked website is at the user’s own risk. 

ARBITRATION AND CLASS ACTION WAIVER 

In the event of any dispute between you and us regarding these Terms of Use, the Website and/or any products or services purchased from the Website, you and Momentum Nation, and/or Baptiste Institute agree to first send the other party a notice of dispute, which is a written statement setting forth the name, address and contact information of the party giving the notice, the facts giving rise to the dispute and the relief requested. You must send any notice of dispute to Baptiste Institute. We will send any

notice of dispute to you at the contact information we have for you. You and Momentum Nation, and/or Baptiste Institute will attempt to resolve any dispute through informal negotiation within 30 days from the date that the notice of dispute is sent. If we are unable to resolve a dispute by negotiation, you agree that disputes must be resolved through binding arbitration rather than by a court, provided that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these Terms of Use. There is no judge or jury in arbitration and court review of an arbitration award is limited. It is important that you understand that the arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction. 

The arbitration will be conducted by the American Arbitration Association (“AAA”) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. You agree to arbitrate with Baptiste Institute only in your individual capacity and not as a representative or member of a class or in any consolidated or representative proceeding. As such, your claims may not be joined with any other claims and there shall be no authority for any dispute to be arbitrated on a class-action basis or brought by a purported class representative. No arbitration or proceeding can be combined with another without the prior written consent of all parties to the arbitration or proceeding. If the class action waiver is found illegal or unenforceable as to all or some parts of a dispute, those parts will be severed and proceed in a court of law, with the remaining parts proceeding in arbitration. For certain claims, like violations of these Terms of Use or breaches of intellectual property covenants, we reserve the right to seek injunctive relief in a court of competent jurisdiction. All arbitrations shall be initiated in Salt Lake City, Utah. 

ONE-TIME FEES AND SUBSCRIPTION FEES 

We offer subscription-based access to some of our content as well as one-time purchases of Momentum Nation, and/or Baptiste Institute courses intended to cover a specific area of study or on a particular topic that can be viewed for a period of time. We reserve the right to cancel, interrupt, or reschedule any of our content, including classes, programs, series or Momentum Nation, and/or Baptiste Institute courses. Subject to your payment of any applicable fees and your compliance with all of the other terms herein, we grant you a non-exclusive, non-transferable, limited right and license to view our content for non-commercial and private use, so long as such content remains available on the Website. 

The subscription fee of Momentum Nation, and/or Baptiste Institute courses is billed prior to commencing the course. You are not entitled to a partial refund in the event the courses are not completed. If your membership is terminated due to a violation of the terms herein, we will not reimburse you for the remainder of any course. 

We may from time to time provide course or program materials that you may download from the Website and/or its counterparts. Such materials may only be used for your own personal, non-commercial use and you may not otherwise copy, reproduce, distribute, publish, commercially exploit or create derivative works from our materials.

IMPORTANT AUTOMATIC RENEWAL AND SUBSCRIPTION-BASED PRODUCTS/SERVICES 

We offer certain products and services on an automatic or subscription basis, so you can enjoy all the benefits of our products or services on a continuous basis. If you choose this option at the time of your purchase, you agree such products/services will automatically renew at the frequency disclosed to you at the time of your initial purchase. By choosing the automatic renewal and subscription option, you acknowledge and agree your subscription will automatically renew at the then current rate, and unless you cancel, you authorize us to charge your payment card for the products/services you purchased, plus applicable shipping and handling, and taxes. If you purchased a subscription with a free trial period, you authorize us to charge your payment card when the free trial period ends, unless you cancel your subscription before the free trial period ends, and you will not receive a notice from us that your free trial period has ended. You may only use a free trial once. We reserve the right to terminate any account that is using or trying to use more than one free trial. The charges will typically occur on or around the same day of the month as your initial purchase, although some charges may be delayed for business or legal reasons. Your automatic subscription will continue until you or we cancel your order. You may cancel your subscription at any time by accessing your account online. Any cancellation of your subscription must be received by us at least one (1) day prior to the next scheduled payment date in order to take effect for that period. If you cancel less than one (1) day prior to the automatic renewal day for your subscription, your subscription will continue as scheduled and your cancellation will take effect in the following period.

Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. 

CERTIFICATION AND DISCLAIMER OF AFFILIATION WITH ACCREDITATION BODY 

Our content is offered by use for your personal use and information purposes only and do not make you eligible for certification by any governing or accreditation body to teach yoga. We are not a member of any yoga-related governing or accreditation body and therefore cannot guarantee that the curriculum meets the standards developed by such organizations. To the extent we offer certification, it is coming from us directly and there is no guarantee that any third party will recognize such certification and allow you to teach yoga. Further, you expressly waive and release Momentum Nation, Baptiste Institute, (“Baptiste Yoga”) its directors, principals, instructors, employees, affiliates and representatives of any claim arising from or in connection with teaching yoga or a violation of the terms as provided herein. 

YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING AGREEMENT, AND THAT BY USING OR ACCESSING THE WEBSITE (ITS CONTENTS, AND COUNTERPARTS), YOU ARE AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN. 

I UNDERSTAND THAT THIS IS A LEGAL AGREEMENT IN WHICH I FREELY GIVE UP MY RIGHT TO A JURY OR COURT TRIAL.
